Poland to appeal Strasbourg CIA ruling

Prosecutor-General Andrzej Seremet has said Poland’s appeal against the European Court of Human Rights decision has reached the final stage of preparation after the court found the country had violated human rights of prisoners held in secret CIA prisons.

The Court in Strasbourg ruled earlier this year that Poland had violated articles of the European Convention on Human Rights by knowingly allowing CIA-operated bases on its territory, ordering it to pay compensation to two terrorist suspects.

The charges against Poland were brought by Abu Zubaydah, a Palestinian, who was arrested in Pakistan and Abd al-Rahim al-Nashiri, a Saudi, who was 'renditioned' in Dubai. Both men say they were held and tortured in a secret detention centre known by the code-name 'Quartz'.

Polish politicians have denied any knowledge of the secret prison.

Andrzej Seremet commented that “the appeal of the Polish side to the Court to re-consider the case before the Grand Chamber is about to be finalized.”

Explaining the justifications behind an appeal, he said “we could not provide materials to the investigation due to its classified nature... Two principles clashed here: the desire of the Court for a public hearing of the case, and national interests. ”

One of the accusations upheld against Poland by the Court was a lack of co-operation with the investigation, as Poland withheld some material. (sl/pg)
